General terms and conditions of business

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts concluded via our online shop between the company BECHBERGER (hereinafter referred to as "Provider") and you as a customer. The GTC apply to all orders from private customers (B2C) and business customers (B2B) via the online shop as well as to orders placed by other means, e.g. by email.
1.2 Deviating conditions of the customer will not be recognized unless the provider expressly agrees to their validity.

2. Subject matter of the contract

2.1 The provider offers gluten-free granola, pastries, cakes and other gluten-free baked goods that are available via our website or can be prepared according to individual wishes and requirements for B2B customers. The products are aimed at end customers as well as business customers (e.g. cafés, restaurants, hotels) who want to offer a gluten-free range.
2.2 All representations of the products on our website or other platforms do not constitute a legally binding offer, but rather an invitation to place an order.

3. Conclusion of contract

3.1 By submitting the order, the customer makes a binding offer to purchase the gluten-free goods contained in the shopping cart.
3.2 The provider reserves the right to refuse orders without giving reasons.
3.3 A contract is only concluded when the provider accepts the order by sending a confirmation via email. For B2B customers, individual agreements also apply, provided they have been confirmed in writing.

4. Prices and Payment

4.1 All prices are stated in euros (€) and include statutory VAT for end customers and exclusive of VAT for B2B customers, unless otherwise agreed. Shipping costs are shown separately and invoiced to the customer.
4.2 Payment is made using the payment methods offered by the provider during the ordering process. The provider reserves the right to exclude certain payment methods. Individual payment terms can be agreed for B2B customers.

5. Shipping and Delivery

5.1 Delivery will be made to the delivery address specified by the customer.
5.2 The delivery time is usually between 3 and 7 working days, but can vary depending on the availability of the goods and production time. Custom orders for B2B customers may have different delivery times, which are specified in the order confirmation.
5.3 If a product is not available, the customer will be informed immediately and any payments already made will be refunded.

6. Right of withdrawal and return

6.1 Due to the nature of our products (food), returns are not possible. Food, especially fresh and perishable goods such as granola, pastries, etc., are excluded from the right of withdrawal.
6.2 The customer therefore has no right of withdrawal after receipt of the goods.

7. Complaints

7.1 If there is a complaint about the delivered goods (e.g. in the case of obvious defects or other quality problems), the customer must contact the provider immediately, but no later than within 3 days of receipt of the goods, by email to info@bbapl.de .
7.2 The customer must describe the defect precisely and, if necessary, send photos of the defective goods so that the provider can examine the complaint.

8. Liability

8.1 The provider is not liable for damages caused by improper storage or use of the delivered products.
8.2 The provider is only liable for minor negligence if essential contractual obligations are violated. In this case, liability is limited to the damage that is typical for the contract and foreseeable.
8.3 Despite careful production and use of gluten-free ingredients, 100% freedom from gluten-containing traces cannot be guaranteed due to unavoidable circumstances. The provider is not liable for allergic reactions or intolerances that could be due to traces of gluten.

9. Data Protection

9.1 The provider collects and processes the customer’s personal data only within the framework of the statutory provisions and the data protection declaration, which can be viewed on our website.

10. Applicable law and place of jurisdiction

10.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
10.2 The place of jurisdiction for all disputes arising from or in connection with this contract is, to the extent permitted by law, the registered office of the provider.
